My main areas of legal research, teaching, and writing are: Constitutional Law and Legal Ethics
Please click above for a selected list of
publications. Several of my books
include the following:
· Problems and Materials on Professional Responsibility (Foundation Press, New York, N.Y., 11th ed. 2011), the leading course book in legal ethics, along with a yearly supplement, coauthored with Professor Thomas D. Morgan. These books are used in approximately 254 different academic institutions (on the college or law school level.)
· Six volume Treatise on Constitutional Law: Substance and Procedure (4th ed., Thomson-West, St. Paul, Minn. 2007-2008) coauthored with Professor John E. Nowak, with annual supplements, cited in thousands of state and federal courts decisions and scholarly articles.
· Constitutional Law (8th ed. Thomson-West, St. Paul, Minn. 2010)(coauthored with Professor John E. Nowak).
· Modern Constitutional Law: Cases and Notes (9th ed., West Thomson Reuters, St. Paul, Minn. 2009), a widely used casebook on Constitutional Law.
· Legal Ethics: The Lawyer's Deskbook on Professional Responsibility (ABA Thomson-West & ABA, 9th ed. 2011), a one-volume treatise on Legal Ethics, the recipient of rave reviews (coauthored with Professor John Dzienkowski).
· Professional Responsibility: A Student’s Guide (ABA Thomson-West & ABA, 2011-2012) (“the premier text that examines the ABA Model Rules of Professional Conduct, the ABA Code of Judicial Conduct, the American Law Institute’s Restatement of the Law Governing Lawyers, and the case law”)
· Joseph Story’s Commentaries on the Constitution (Carolina Academic Press, Durham, N.C. 1987) (with introduction), coauthored with Professor John E. Nowak.
· Legal Ethics in a Nutshell (West Group, St. Paul, Minnesota, 3rd ed. 2007, Nutshell Series).
· 언론의 자유와 미국 헌법, [Freedom of Speech and the American Constitution] (Korean Studies Information Co. Ltd., Korea, 2007) (translated into Korean by Professor Lee Boo-Ha, Yeungnam University College of Law and Political Science), coauthored with Professor John E. Nowak.
"The phrase, 'US Constitution,'
is a phrase familiar to Koreans, but in reality it is an area that is not easy
to approach given our differing legal systems. However, the US Constitution is
applicable in many different aspects of our (Korean) Constitution. Comparative
study of other countries' constitutions provides an important tool in
understanding our current Constitution. Comparative studies focusing solely on
the different countries' constitutions provide insufficient understanding of
the constitutions' fundamental characteristics; therefore, an analysis of how
the Constitution gets interpreted and applied through analysis of caselaw
provides important insights into understanding the constitution."
